When Office of Hearings Operations (OHO) management, through designated staff, has notified a claimant of the time and place set for a hearing, and it becomes necessary before the hearing begins to change the time or place of the hearing, OHO management, through designated staff, will send the claimant an amended notice of hearing. With the amended notice, OHO management, through designated staff, will also send an acknowledgement form.
OHO management, through designated staff, will distribute the amended notice of hearing in the same manner noted in Hearings, Appeals and Litigation Law (HALLEX) manual I-2-3-15, except that we will mail or serve the amended notice at least 20 days in advance rather than 75 days in advance. The date of hearing indicated in the amended notice will be at least 75 days from the date we first sent the claimant a notice of hearing, unless the claimant has waived the right to advance notice.
